This decision means that Trump, a clear favorite for the GOP presidential nomination, will be allowed to appear on the ballot and have the votes he garners counted.
During oral arguments, the Supreme Court justices expressed skepticism about the Colorado Supreme Court’s reasoning for disqualifying Trump. Justice Elena Kagan questioned why a single state should have the authority to decide who can become President of the United States. The ruling, backed by all nine Justices, highlights that disagreements should be set aside in favor of unity, especially in politically charged situations like a Presidential election. The decision also affects similar rulings in Maine and Illinois, where Trump was also barred from their primary ballots based on the same interpretation of the 14th Amendment’s Section 3.
The 14th Amendment’s Section 3, designed to prevent former Confederates from returning to power post-Civil War, states that individuals who engaged in insurrection or rebellion against the U.S. cannot hold federal office. In the aftermath of the Capitol riot, where Congress members fled and certification of President Biden’s victory was delayed, a Denver District Court judge had allowed Trump to appear on Colorado’s ballot, despite acknowledging his involvement in incitement. The Supreme Court’s ruling clarifies that federal enforcement of Section 3 must come from Congress, not individual states, emphasizing judicial impartiality and adherence to the law.
