SoundCloud Updates Policies to Permit AI Training on User Content

SoundCloud has reportedly updated its terms of use, allowing the company to train AI on audio uploaded by users. This change was noted by tech ethicist Ed Newton-Rex, who identified a provision in the latest terms that permits the platform to use uploaded content for AI-related purposes.

The updated terms, effective from February 7, state that user content may be used to inform, train, develop, or serve AI technologies as part of the service. However, there is an exception for content governed by separate agreements with third-party rights holders, such as record labels. SoundCloud has agreements with various indie labels and major publishers, including Universal Music and Warner Music Group.

TechCrunch was unable to locate an explicit opt-out option in SoundCloud’s settings, and the company has not immediately commented on this issue. SoundCloud, like other major platforms, is increasingly integrating AI. Last year, it collaborated with several vendors to introduce AI-powered tools for remixing and generating music.

These partners receive access to content ID solutions to ensure that rights holders receive appropriate credit and compensation. SoundCloud has committed to maintaining ethical AI practices that respect creators’ rights.

Recently, several content hosting platforms have modified their policies to allow AI training. Examples include policy changes by Elon Musk’s X, LinkedIn, and YouTube, which have led to user backlash. Users are advocating for opt-in approaches and proper compensation for contributions to AI datasets.

A SoundCloud spokesperson clarified that the company has not used artist content to train AI models and does not permit third parties to misuse SoundCloud content for AI training. Technical safeguards have been implemented, such as a “no AI” tag, to prevent unauthorized use.

The February 2024 terms update intends to clarify interactions with AI within SoundCloud’s platform, focusing on personalized recommendations, fraud detection, and content organization. Future AI applications will support artists by enhancing tools and opportunities in line with existing agreements and ethical standards.

SoundCloud remains committed to transparency and will ensure that artists retain control over their work as AI technologies evolve.
